These Terms of Service (“Terms”) govern your use of EasyPoolShop.com and purchases or requests made through Easy Pool Shop and Easy Pools (collectively, “Easy Pool Shop,” “we,” “us,” or “our”). By accessing the website, placing an order, purchasing or enrolling in a service, membership, or subscription, or submitting a service request, you agree to these Terms and the policies referenced here.
1. ONLINE STORE AND ELIGIBILITY
You may use the website only for lawful purposes. By making a purchase, you represent that you are legally able to enter into the transaction. You may not misuse the website, interfere with its operation, introduce malicious code, attempt unauthorized access, or use our products or services for unlawful purposes.
2. PRODUCTS, LOCAL DELIVERY, AND SERVICE AREA
Easy Pool Shop is a Greater Austin-area business. We do not ship physical products through nationwide parcel delivery. Chemicals, supplies, test kits, and other physical goods purchased through the store are fulfilled by Easy Pools staff only within eligible Greater Austin service areas.
An address accepted by Shopify checkout does not by itself guarantee delivery eligibility. If a physical-product order is placed for an address we cannot serve, we may contact the customer and cancel and refund the affected order. Shopify may use terms such as “shipping,” “shipping address,” or “shipping method”; for our physical products, those terms may refer to local delivery and fulfillment.
Delivery timing depends on product availability, location, access, and staff route scheduling. Customers are responsible for providing accurate delivery and access information.
3. SERVICES, POOL SCHOOL, AND INSPECTIONS
Services may include pool inspections, Pool School, onsite water analysis, chemical services, repairs, maintenance-related services, Connected Pool Management, and other offerings described on the website. Availability, eligibility, scope, scheduling, and pricing may depend on property location and service requirements.
Free Pool School is a qualification request. Submitting a request does not guarantee eligibility, acceptance, or an appointment. Paid appointments and services are subject to the cancellation and rescheduling terms stated in our Refund Policy or in terms presented when booking.
4. MEMBERSHIPS AND SUBSCRIPTIONS
Some offerings include memberships or recurring subscriptions. The price, billing frequency, included benefits, and any applicable purchase terms are presented when the customer enrolls. By purchasing a recurring offering, you authorize recurring charges according to the billing terms presented at checkout until the subscription is canceled in accordance with the applicable cancellation terms.
Connected Pool Management or professional monitoring may include a one-time equipment, installation, or activation component and a separate recurring monitoring component as described on the applicable product page and at checkout.
Memberships and subscriptions may be canceled before the next renewal date to prevent future charges, subject to the terms presented at purchase and our Refund Policy. Cancellation generally does not reverse a charge that has already been processed or require a refund for benefits already used.
5. PRICES, TAXES, DISCOUNTS, AND AVAILABILITY
Prices, promotions, discounts, product availability, and service offerings may change without notice unless otherwise required by law. Applicable taxes and charges are calculated or displayed during checkout. Discount codes and promotions are subject to their stated eligibility requirements and may be modified or discontinued where permitted by law.
We may limit quantities, decline or cancel orders, correct pricing or product-information errors, and discontinue products or services. If we cancel an order after payment because we cannot fulfill it, we will issue an appropriate refund for the canceled amount.
6. ACCURACY OF INFORMATION
We work to keep product, service, pricing, educational, and website information accurate, but errors or omissions may occur. We may correct errors, update information, or modify the website without prior notice. Pool-care and educational information is general information and does not replace an onsite evaluation when site-specific conditions are material.
7. RETURNS, REFUNDS, AND CANCELLATIONS
Returns, refunds, appointment cancellations, damaged or incorrect products, chemicals and hazardous materials, memberships, and subscriptions are governed by our current Refund Policy.
Local delivery is governed by our current Local Delivery/Shipping Policy. Those policies are incorporated into these Terms by reference.
8. CUSTOMER ACCOUNTS AND ORDER INFORMATION
You agree to provide current and accurate purchase, billing, delivery, service-property, and contact information. You are responsible for maintaining the confidentiality of account credentials under your control and for promptly notifying us of suspected unauthorized account use.
9. THIRD-PARTY SERVICES
Our website and operations may use third-party platforms and service providers, including Shopify and providers for payments, subscriptions, analytics, communications, scheduling, marketing, or other business functions.
Third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party websites or services that are outside our control.
10. INTELLECTUAL PROPERTY
Unless otherwise indicated, website content created by or for Easy Pool Shop, including text, branding, graphics, educational materials, and site design elements, is owned by or licensed to us and is protected by applicable intellectual-property laws.
You may use the website for ordinary personal or business purchasing purposes but may not reproduce, republish, sell, or commercially exploit protected content without permission.
11. PROHIBITED CONDUCT
You may not use the website or services to violate law; infringe intellectual-property or privacy rights; transmit malware; engage in fraud; collect information through unauthorized scraping or automated access; interfere with security or website operation; impersonate another person; or submit materially false information.
12. DISCLAIMER
To the fullest extent permitted by applicable law, the website and general informational content are provided on an “as available” basis. We do not guarantee that website access will always be uninterrupted or error-free.
Product warranties, manufacturer warranties, written service agreements, and rights that cannot legally be disclaimed remain governed by their applicable terms and law.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Easy Pool Shop and its owners, officers, employees, agents, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or products or services, except where such limitation is prohibited by law.
Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.
14. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Easy Pool Shop and its affiliates, officers, employees, agents, and contractors from third-party claims arising from your unlawful misuse of the website, your violation of these Terms, or your infringement of another party’s rights.
15. SEVERABILITY AND WAIVER
If a provision of these Terms is determined to be unenforceable, the remaining provisions will continue in effect to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later.
16. GOVERNING LAW
These Terms and transactions with Easy Pool Shop are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our business, services, technology, or legal requirements. The current version will be posted with its updated date. Changes apply prospectively except where applicable law permits otherwise.
